By accessing or using Randomify ("the Service"), operated by CASE.DE GMBH, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Randomify is a platform that enables users to conduct provably fair giveaways on social media platforms. The Service allows users to connect their Facebook and Instagram accounts, import comments from posts, and select winners using a cryptographically verifiable random selection process.

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4. Social Media Integration

The Service integrates with third-party social media platforms including Facebook and Instagram. By connecting your social media accounts, you authorize us to access certain information from those accounts as described in our Privacy Policy.

You represent that you have the authority to connect any social media accounts you link to the Service and that your use of the Service complies with all applicable terms and policies of those platforms.

5. Acceptable Use

You agree not to use the Service to:

  • Conduct fraudulent, deceptive, or illegal giveaways
  • Violate any applicable laws, regulations, or third-party rights
  • Violate the terms of service of connected social media platforms
  • Manipulate or attempt to manipulate giveaway results
  • Collect personal information of participants for unauthorized purposes
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to any part of the Service

6. Giveaway Compliance

You are solely responsible for ensuring that any giveaways you conduct using the Service comply with all applicable laws, regulations, and platform policies. This includes, but is not limited to:

  • Local, national, and international sweepstakes and contest laws
  • Facebook and Instagram promotion guidelines
  • Tax reporting requirements for prizes
  • Age restrictions and eligibility requirements
  • Required disclosures and official rules

CASE.DE GMBH does not provide legal advice and is not responsible for the legality of giveaways conducted using the Service.

7. Subscriptions and Billing

Randomify offers free and paid subscription plans. By subscribing to a paid plan, you agree to the following:

  • Billing: Paid subscriptions are billed monthly in advance. Payments are processed securely by Stripe, Inc.
  • Automatic renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
  • Price changes: We may change subscription prices with 30 days' notice. Price changes will apply to subsequent billing periods.
  • Cancellation: You may cancel your subscription at any time through your account settings or the Stripe billing portal. Access continues until the end of the current billing period.
  • Refunds: Subscription fees are generally non-refundable. Exceptions may be made at our discretion for technical issues or billing errors.
  • Downgrades: If you downgrade to a lower tier, the new pricing applies at the next billing cycle. Features exceeding your new plan limits may become restricted.

Prices are displayed in Euros (€) and include applicable taxes where required.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by CASE.DE GMBH and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. We make no warranties regarding the accuracy or reliability of any information obtained through the Service.

10. Limitation of Liability

To the maximum extent permitted by law, CASE.DE GMBH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless CASE.DE GMBH and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through your account settings.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Bonn, Germany.
