2. Description of Service

Randomify allows users to run verifiable, legally compliant Instagram giveaways using the official Meta Graph API. The Service fetches comments from Instagram posts, applies filtering rules, and performs cryptographically random winner selection with a full audit trail.

3. Eligibility

  • You must be at least 18 years old.
  • You must have a valid Instagram Business or Creator account connected to a Facebook Page.
  • You are responsible for complying with Instagram's Platform Policy and Meta's Terms of Service when running giveaways.

4. User Responsibilities

  • Legal compliance: You are solely responsible for ensuring that your giveaway complies with all applicable laws, including the UWG and GDPR.
  • Teilnahmebedingungen: You must publish clear participation terms for each giveaway.
  • Meta release: Your giveaway terms must include a statement that the promotion is not sponsored, endorsed, or administered by Instagram/Meta.
  • No gambling: You must not use the Service for pay-to-enter competitions or any form of gambling as defined by the Glücksspielstaatsvertrag (GlüStV).

5. Plans & Usage Limits

The Service offers a free plan and paid plans with different limits. Current plan details are available in the dashboard. We reserve the right to change plan features and pricing with 30 days' notice.

6. Data Handling

Please refer to our Privacy Policy for details on how we process personal data.

  • Comment data is deleted immediately after each draw.
  • Only a non-reversible hash is retained for audit purposes.
  • Access tokens are encrypted at rest and never shared with third parties.

7. Intellectual Property

Randomify and its source code, design, and documentation are the intellectual property of the operator.

8. Limitation of Liability

  • The Service is provided "as is." We do not guarantee uninterrupted availability.
  • We are not liable for the outcome of any giveaway, including disputes with participants.
  • Our liability is limited to the amount you have paid for the Service in the 12 months preceding the claim.
  • This limitation does not apply where mandatory German law provides otherwise.

9. Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. The courts of [CITY] have exclusive jurisdiction, subject to mandatory consumer protection rules.
